Terms of Use

Hoodly is a market-mapping tool covering cities across Canada. It produces site-intelligence PDF reports for independent cafe and restaurant operators. By using this site or requesting a report, you agree to these terms. Which cities are available for a paid report, and at what data grade, is shown in the city picker and changes over time; cities marked as previews are map-only and cannot be purchased.

This is a business service

Hoodly is offered for business and commercial purposes — evaluating a commercial lease or siting decision — and is not directed at consumers or intended for personal, family or household use. By purchasing, you confirm you are acquiring the report for the purposes of a business, and that you are not entering this agreement as a consumer. Nothing here is intended to remove any protection that applies to you by law regardless (see What these limits do not cover below).

The report is decision support, not a recommendation

Each report is an analytical summary of public data signals around an address in a city Hoodly covers. It is not:

Before signing any lease or making any committed investment, you should commission independent legal, zoning, financial, and feasibility review from licensed professionals in those domains.

You agree to verify independently

You acknowledge and agree that you will not rely on a Hoodly report as the sole basis for any lease, purchase, financing or other committed decision, and that you will independently verify anything material to that decision — including zoning and permitted use, actual foot traffic, rent and occupancy costs, the condition and availability of the premises, and the competitive picture on the ground. A report is one input among several. You accept the risk of any decision you make, and you accept that data drawn from public sources can be incomplete, stale or wrong.

Data sources and accuracy

Reports synthesize public and partner data. Hoodly does its best to keep this data current but makes no warranty as to its completeness, accuracy, or timeliness. Specifically:

Machine-generated analysis

The written analyst narrative in each report is generated by a large language model from the computed signals. It is produced automatically, is not reviewed by a person before delivery, and can misstate, over-generalise or misinterpret the underlying numbers. Where the narrative and the structured figures disagree, the structured figures govern. Treat the narrative as a readable summary, never as an independent expert opinion, and never as a representation by us about the location.

Pricing

Each report is a one-time purchase. Price depends on the data grade available for that city — currently CAD $15, $9 or $5 — and the exact price is shown in the panel before checkout and again on the Stripe-hosted payment page. Prices may change at any time; the price shown at checkout is the price that applies to that purchase. Payment is processed by Stripe; we don't see or store your card details.

If something looks wrong, and refunds

If something in the report doesn't look right — wrong corner, missing context, data clearly out of date — email frank@feepfoop.com and we'll re-run the report for the same corner (or a nearby one if you mis-pinned), free of charge. We'd rather get the report right than process a refund.

Because a report is a digital product delivered immediately, purchases are otherwise final. If a re-run doesn't resolve it, contact us before starting a chargeback — we will consider a refund of the amount you paid on a case-by-case basis, and we would rather settle it directly. Initiating a chargeback without contacting us first may result in service being refused in future.

Disclaimer of warranties

The map, the reports and everything else Hoodly provides are supplied "as is" and "as available", without warranty of any kind, whether express, implied or statutory. To the maximum extent permitted by law we disclaim the implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. No advice or information you get from us, whether spoken, written or generated by the analyst narrative, creates any warranty not expressly stated here.

Limitation of liability

To the maximum extent permitted by law:

These limits apply however the claim arises — contract, tort including negligence, statute, or any other basis — and apply even if a limited remedy is found to have failed of its essential purpose. If you use only the free map and have paid us nothing, the CAD $50 figure is the cap.

Why the cap is set where it is

You acknowledge that the limits above are a deliberate allocation of risk between us, and that the price of a report reflects that allocation. A report costs a few dollars; the decisions it informs involve leases worth hundreds of thousands. We could not offer the product at this price if we carried the downside of those decisions. If you need someone to stand behind a siting decision financially, the right people are a licensed appraiser, broker or consultant carrying professional liability insurance — not a $15 data report. You accept that these limits are reasonable in that light, and that they are an essential basis of the bargain between us; without them, we would not sell the report at this price or at all.

Indemnification

You agree to indemnify, defend and hold harmless Hoodly, Wannanap Labs, and their officers, directors, employees and contractors from and against any claim, demand, investigation, loss, liability, damages, fine, cost or expense — including reasonable legal fees — arising out of or connected with:

We will tell you promptly about any claim we want indemnified. You may control the defence using counsel we find reasonably acceptable; we may take part at our own expense; and you may not settle in a way that admits fault on our behalf, or imposes any obligation on us, without our written consent.

Time limit for claims

To the extent the law allows it to be agreed, any claim connected to Hoodly must be started within one year of the event giving rise to it, or it is permanently barred.

What these limits do not cover

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited. That includes liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, and any rights you have under the Consumer Protection Act, 2002 (Ontario) or other consumer-protection legislation that cannot be waived by agreement. If a court finds any limitation above unenforceable, it applies to the greatest extent permitted and the rest of this section stays in force.

Intellectual property

Jurisdiction

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the courts of Toronto, Ontario, and you attorn to that jurisdiction. If you use Hoodly from outside Canada, you do so on your own initiative and are responsible for complying with your own local law.

Which document wins

These Terms of Use and the End User Licence Agreement together form the whole agreement between us about Hoodly, and replace any earlier understanding, representation or statement — including anything on the marketing pages or in email. Where the two documents cover the same ground, the EULA governs your rights in the material (the reports, the map, the data) and these Terms govern everything else about the service. The liability limits in the two documents are a single aggregate cap, not two separate ones.

Severability, waiver, assignment and survival

Availability and interruption

We don't promise the site or the report pipeline will be available continuously or uninterrupted. We may change, suspend or discontinue any part of Hoodly — including dropping a city, changing a data grade, or retiring the product — at any time and without notice. We are not liable for any consequence of doing so, and we are not liable for delay or failure caused by anything outside our reasonable control, including upstream data sources, payment processors, hosting providers, or outages affecting them.

Changes

If we change these terms, the "Last updated" date above will change, and continuing to use Hoodly after that date means you accept the new version. Material changes will be noted on the homepage for at least 30 days. The version in force when you bought a report governs that purchase.
